What information do we collect about you?
We collect information about you when you register for property alerts with Nicol Estate Agents either by telephone or visiting one of our offices, enquire about a property we are marketing, signed up through our website or instruct us to sell your property.
How will the information collected about you be used by Nicol Estate Agents?
We collect information about you in order to provide you with our property services as instructed by you.
These services include but are not limited to; carrying out a market appraisal of property, marketing a property for sale, replying to enquires about properties we have for sale including arranging viewings and obtaining viewing feedback for the vendor, negotiating, agreeing and progressing an offer on properties for sale, including checking purchaser’s credentials with their solicitors.
We may contact you to offer our services if we have a legitimate reason to do so, for example; if we have carried out a market appraisal on your property previously and recently sold property in your locality we may contact you to see if you were interested in instructing our services formally given the activity in your area. Likewise if you have enquired about a specific property and another of the same type comes onto the market we may contact you to ascertain if you would be interested.
With your consent, we will add you to our property applicant mailing list and will contact you by email or telephone regarding other properties that maybe of interest to you via our property alerts and property match services. These email correspondences may also provide brief updates about market conditions, useful information when buying or selling a property.
Nicol Estate Agents will not share your information for marketing purposes outside of our organisation without separate, clear and explicit consent. Third parties who process data for Nicol Estate Agents in order to provide our service to you include but are not limited to:
- Photographers and Floorplan companies
- Rycramweb Ltd
- Fourfifteen Ltd
- Surveyors, Solicitors, and Financial Advisors instructed in relation to a sale of a property.
- Carruthers & Co Accountants
- Maintenance and trades peoples
We will not disclose any information to any company outside of those listed except to help to prevent fraud, or if required to do so by law.
Marketing
As an applicant looking for a property to buy we would like to send you information about properties and services of our company that maybe of interest to you. If you have consented to receive marketing, you may opt out at a later date using the ‘unsubscribe link’ contained within all our marketing emails and property alerts.
We will only refer you to third party companies for services we do not provide directly, only once separate and clear consent has been given by you.
You have a right at any time to stop Nicol Estate Agents from contacting you for marketing purposes. If you no longer wish to be contacted for marketing purposes please contact Nicol Estate Agents using the details below to enable your ‘right to be forgotten’.
Access to your information, correction, holding your data.
You have the right to request a copy of the information that we hold about you. If you would like a copy of some or all of your personal information, please email or write to Nicol Estate Agents at the contact information below. We may make a small charge for this service.
We want to make sure that all your personal information is accurate and up to date. You may ask Nicol Estate Agents to amend or remove information you think is inaccurate.
We review the data on our list every three years. If you are still on our database (and have not unsubscribed) three years after you joined the list, we will contact you by email to see if you wish to remain on our database to find a new home or unsubscribe.

Appropriate privacy controls and measures are built into our systems that process personal data. All our processes and procedures include and reflect current requirements of the General Data Protection Regulation (GDPR) and our staff are given full and ongoing training.
Data Breaches
If a data breach were to occur it is reported to the Data Office immediately who will in turn report it to the Information Commissioners Offers (ICO) within 72 Hours. Following the investigation by the ICO you may or may not be notified of any breach depending on its severity and the instructions of the ICO.
